Acceptable Use Policy (AUP) and Terms & Condition (T&C) Xsinor issues this document. The company shall be known throughout this document as Xsinor.
By using our services, you are AGREE to the AUP and Terms & Conditions stated in our website.
1. Content
All hosting & server services provided by Xsinor may be used for lawful purposes only. Transmission, storage, selling, or presentation of any information, data, item, product, or material in violation of Malaysia (or any other country) law is prohibited. This includes, but is not limited to: copyrighted material, material that is threatening or obscene, material that is “adult only” content, selling illegal products, items, or material protected by trade secrets and other statues. The subscriber agrees to indemnify and hold harmless Visual Idea Network from any claims resulting from the use of the service which damages the subscriber or any other party.
Examples of Non-Acceptable Contents, Links, Items, or Products:
Free Hosting
Pirated software
Adult Websites
Torrents
Hacking programs or archives Warez Sites
Illegal MP3’s or Media (Including any format image)
Spamming Software
Scamming, Phishing, Email Spam, Gambling, Botnet, Port Scan
Virus, Malware, Adware & Harmful Contents
Defamatory Statement
Selling Items or Products that is Deemed to be Illegal
Selling of Health, Medicine, Beauty, Supplement, or Consumable Products that are not Approved by its Respective Government Body
Please note that if the subscriber violated the terms & conditions even if not explicitly listed above, Visual Idea Network has the right to suspend or terminate the service without refund.
Blacklisting
Effective as of August 1st, 2023, we will be implementing routine checks on all IPs to identify any blacklisted RDNs. If any RDNs are discovered on the blacklist, they will be promptly removed without any prior notice. It’s important to note that blacklisted IP servers will not be eligible for refunds.
SPAM & Abuse Fees (All Services)
Effective from 20/12/2022, we will collect the abuse fees $30 (apox. RM150) per abuse if the user triggers the abuse. For the first warning from our abuse team was not counted, in the second warning, the abuse team will be suspend the server network and client should make the abuse fees payment by $30 (apox. RM150) to re-activate the server. If client refuse to make payment the abuse fees, the server will be terminate immediately. Please note that we would not responsibility the data lost and refund.
Storage
The storage capacity provided with the hosting plan you have purchased is defined as disk space. It is used in order to place content such as your web pages, databases, and email accounts. You can not use the provided disk space as backup storage, media for file transfer (via FTP, HTTP and etc.), or file sharing storage.
In order to use this space for shared hosting, you have to respect the following conditions:
You may only store your website’s content. It is forbidden to use it for personal or unrelated pieces of data that are not part of your website.
If we detect you are using the disk space for other purposes, we can end the hosting contract and terminate your account.
Define “Unlimited” or “Unmetered”
While we provide Unlimited/Unmetered services, it is important to note that the disk space cannot be abused for purposes such as using it solely as backup storage or storing content unrelated to your website. Any archive or zip file found will be promptly removed from the server.
2. Service Deploy Timeframe
Below is the period of time for the service to deploy once the payment is complete:
Domain Register & Transfer – Within 24 hours (Included Public Holiday & Weekend)
Hosting & Reseller Hosting – Within 24 hours (Included Public Holiday & Weekend)
VPS Server / Cloud Server – Within 24 hours (Included Public Holiday & Weekend)
German Cloud Server VDS – Within 24 – 72 hours (Included Public Holiday & Weekend)
Dedicated Server – Within 24 – 48 hours (Included Public Holiday & Weekend)
SSL Certificates – Within 24 hours (Included Public Holiday & Weekend)
3. Payment
We support various payment method to assist client make smoothly payment, the payment method including:
a) PayPal/PayPal Transfer
b) Malaysia Payment Gateway (International Card Accepted)
4. Money-Back Guarantee / Refund Policy
Below is the service Money-Back Guarantee as the list below:
a) Hosting & Reseller Hosting – 30 Days
b) Domain – Non-Refundable after registration
c) VPS / Cloud Server – 5 Days
d) Dedicated Server –5 Days
e) German Server – 5 Days
f) SSL Certificate & Other Security Services – 14 Days
Please note that any violated the terms & conditions are NOT eligible for refunds.
Payment Refund Period
a) PayPal – Within 3 to 7 working day.
b) Malaysia Gateway – Depend on the Malaysia Bank process, could be taken up to 14 days.
Refund & Chargeback Policy
4a. Refund Requests
All refund or cancellation requests must be submitted directly to Xsinor through our official support channels (email: [support@xsinor.com]).
For security reason, we do not accept refund requests made through banks, payment providers, or third-party platforms.
4b. Refund Eligibility
Refunds are considered only under the following conditions:
The service has not yet been delivered, or
There is a clear error on our side that prevents delivery of the service.
Once the service, digital product, or deliverable has been provided—fully or partially—the sale is considered final and non-refundable.
4c. Non-Refundable Fees (Payment Gateway Charges)
Payment gateway processing fees charged by Gateway Provider (or any payment provider) are non-refundable.
If a refund is approved, the refund amount will be:
Refund Amount = Total Payment – Payment Gateway Fees
This means the customer will receive a partial refund, not the full amount originally paid.
4d. Chargebacks
Customers are required to contact us first before initiating any dispute.
Filing a chargeback without contacting us is considered an unauthorized dispute and may be treated as fraudulent activity, especially if the service was already delivered.
If a chargeback is filed:
We will submit all evidence of delivery, communication logs, and verification records to the issuing bank.
Customers remain responsible for any fees, penalties, or losses resulting from invalid or fraudulent chargebacks.
4e. Duplicate or Accidental Payments
If a duplicate payment is made by mistake, a refund will be issued minus payment gateway fees, unless required otherwise by law.
4f. Agreement
By completing a purchase with Xsinor, the customer acknowledges and agrees to this Refund & Chargeback Policy.
5. Suspend & Terminate.
Service Suspension: In the event of non-payment beyond the invoice due date by a period of 3 days, the service shall be subject to suspension.
Service Termination: In the event of service suspension persisting for a period of 5 days, the service shall be terminated, and it is important to note that the data cannot be restored thereafter.
Germany VPS & VDS: In the event of non-payment beyond the invoice due date by a period of 1 days, the service shall be subject to suspension & termination.
